These Terms of Service ("Terms") are a binding agreement between you and PeptideDx LLC confirm legal name ("PeptideDx," "we," "us," or "our") governing your use of peptide-dx.com and related services (the "Service"). By creating an account, checking the acceptance box, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements and that the information you provide is accurate and belongs to you (or you are authorized to provide it).
2. The Service
The Service lets you upload or enter genomic, epigenomic, and blood-biomarker data and receive informational, research-based peptide insights matched to that data and to goals you select, and to save those results to your account. Content is general and educational in nature and may be incomplete, may not reflect the latest science, and is not tailored medical guidance.
3. No medical advice; no professional relationship
The Service does not practice medicine and does not provide medical, clinical, pharmacological, or other professional advice. Recommendations are algorithmic and informational. Decisions about your health are yours to make with a qualified provider. You are solely responsible for how you use any information from the Service.
4. Accounts and security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
5. Acceptable use
You agree not to:
- Upload data that is not yours or that you are not authorized to submit.
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Attempt to reverse engineer, scrape, overload, disrupt, or gain unauthorized access to the Service or its data.
- Rely on the Service as a substitute for professional medical care.
- Resell or commercially exploit the Service without our written permission.
6. Your data
You retain ownership of the data you submit. You grant PeptideDx a limited, non-exclusive license to process your data solely to operate and provide the Service to you, as described in our Privacy Policy. You are responsible for the accuracy of the data you provide.
7. Intellectual property
The Service, including its software, content, design, and the recommendation logic and knowledge base, is owned by PeptideDx or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service for your personal, non-commercial purposes. All rights not expressly granted are reserved.
8. Third-party services and content
The Service relies on third-party providers (for example, authentication, database, and hosting) and may reference third-party research or products. We are not responsible for third-party services or content, and your use of them may be governed by their own terms.
9. Assumption of risk
Peptides and related compounds may carry health risks, may be regulated, and may be inappropriate for you. You acknowledge that any decision to obtain or use any peptide is made at your own risk and in consultation with a licensed provider, and that PeptideDx does not supply, prescribe, or endorse any specific product or protocol.
10. Disclaimer of warranties
The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. PeptideDx does not warrant that the service will be uninterrupted, error-free, secure, or that any result, insight, or recommendation is accurate, complete, reliable, or suitable for you.
11. Limitation of liability
To the fullest extent permitted by law, PeptideDx and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or health outcomes, arising out of or relating to your use of (or inability to use) the service, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability for all claims relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless PeptideDx and its representatives from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your data, or your violation of these Terms or applicable law.
13. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute not subject to arbitration will be the state or federal courts located in Kentucky, and you consent to their jurisdiction. 14. Changes to these Terms
We may modify these Terms from time to time. We will post the updated version with a new "Last updated" date and, where appropriate, notify you. Your continued use after changes take effect constitutes acceptance of the revised Terms.
15. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
